Terms of Service

1. Description of Service

PoftaQR is a SaaS digital menu platform for restaurants, cafes and bars, operated by Ivan Zhantalay, Romania (hereinafter "the Operator"). By creating an account and using the service, you fully accept these Terms of Service.

2. Use of Service

You may use PoftaQR only for lawful purposes. The following are prohibited:

• Publishing illegal, fraudulent or third-party rights-infringing content.
• Attempting unauthorized access to systems or data of other users.
• Using the service for spam, phishing or any other malicious activity.

3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at contact@poftaqr.ro of any unauthorized access.

4. Subscriptions and Payments

The Free plan is available indefinitely at no cost. Pro and Business paid plans are planned for future availability — the exact launch date will be announced on the website. When paid plans become available, they will be billed monthly via Stripe, renew automatically, and may be cancelled at any time from the admin panel. Currently, paid plan functionality is disabled and users cannot make any payments on the site.

5. Limitation of Liability (Disclaimer)

The service is provided "as-is" without warranties of any kind, express or implied, and is offered free of charge. The Operator does not guarantee uninterrupted availability. The Operator's liability to users is fully excluded for the Free plan: the Operator is not liable for data loss, loss of profit, or any direct or indirect damages resulting from use or inability to use the platform.

6. Modification and Termination

The Operator reserves the right to modify, suspend or discontinue any part of the service at any time, with at least 14 days' prior notice for material changes affecting paid plans. Accounts inactive for more than 12 months may be deleted with at least 30 days' prior notice sent to the email address associated with the account.

7. Governing Law

These Terms are governed by the laws of Romania and the European Union. Any dispute shall be resolved by the competent courts of Romania. If any provision of these Terms is found to be invalid, the remaining provisions remain in full force.

8. Marketing References

The Operator may request your explicit consent to:

• Mention your establishment's name as a PoftaQR client.
• Display your logo in sections such as "Our Clients", "Trusted By", "Case Studies", "Partners" on the PoftaQR website and social media.
• Publish short case studies or testimonials (subject to your prior approval).
• Link to your public QR menu from PoftaQR marketing materials.

The Operator may also propose (but not require) that you place a mention, badge, or link to PoftaQR on your external website (if any). Your explicit consent is required before any such use.

Your consent is requested individually for each of the above. You may refuse or withdraw consent at any time by contacting: contact@poftaqr.ro
